Accepting these terms
These Terms of Service ("Terms") are an agreement between you and SellMyHouseOC ("SellMyHouseOC," "we," "us" or "our"). They apply to sellmyhouseoc.com and to every page, form and feature on it (together, the "Site").
By using the Site, submitting a form, or otherwise contacting us through the Site, you accept these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Site.
If you are using the Site on behalf of a trust, estate, company or another person, you confirm that you have the authority to accept these Terms on their behalf, and "you" includes both you and that party.
Who we are
SellMyHouseOC is a direct residential property buyer serving Orange County, California and the surrounding Los Angeles–Long Beach–Anaheim metropolitan area. We buy single-family homes, condominiums, townhomes and small multi-unit properties, generally in as-is condition, using our own funds or funds we arrange.
We operate as a service-area business. We travel to the properties we evaluate and we close through licensed, independent escrow and title companies in Orange County. We do not operate a retail office open to the public.
Not a brokerage, and not professional advice
We buy property as a principal, for our own account. We are not a licensed real estate brokerage, we do not represent you, and no agency, fiduciary or brokerage relationship is created by your use of the Site or by our discussions with you. We do not list property, we do not market property on your behalf, and we do not charge you a commission.
Because we buy for our own account, our interests are not the same as yours. We intend to buy at a price that allows us to profit after repairs, holding costs and resale. We tell you this plainly because you should weigh our offer against your alternatives.
Nothing on the Site is legal, tax, financial, accounting, appraisal, insurance or investment advice. Selling real property can carry significant tax and legal consequences, particularly in probate, trust, divorce, foreclosure and tenant-occupied situations. You are encouraged to consult your own attorney, accountant, tax adviser or real estate agent before signing anything. We are happy to work alongside your advisers.
Any figures on the Site — timelines, cost ranges, commission percentages, repair estimates or comparisons between a cash sale and a traditional listing — are general illustrations for Orange County, not promises about your property. Your results will depend on your property, your situation and market conditions at the time.
What a cash offer is, and when a sale actually happens
Requesting an offer is free and puts you under no obligation. Likewise, we are under no obligation to make an offer on any property, and we may decline for any lawful reason.
Nothing on the Site is an offer to purchase real property. The Site is an invitation to contact us. Any number we give you before a signed agreement — whether by phone, text, email or written offer sheet — is a preliminary, non-binding, conditional indication of value.
A preliminary offer may be revised or withdrawn, including after we learn of:
- the actual condition of the property on inspection;
- title defects, liens, judgments, unrecorded interests, code enforcement actions or permit issues;
- occupancy, tenancy or leases that were not disclosed;
- heirship, probate, trust or authority questions affecting who may legally sell;
- HOA assessments, transfer requirements or litigation;
- information you provided that turns out to be inaccurate or incomplete;
- a material change in market conditions.
No binding sale exists unless and until you and we sign a written purchase and sale agreement. That agreement, and not this page, sets the price, the contingencies, the deposit, the closing date and every other term of the transaction. If anything in a signed purchase agreement conflicts with these Terms, the purchase agreement controls for that transaction.
We may assign our rights under a purchase agreement to an affiliate or a third party where the agreement permits it. Where we intend to do so, that will be disclosed in the agreement itself.
Eligibility and permitted use
You must be at least 18 years old and legally able to enter into contracts to use the Site. The Site is intended for users in the United States and is not directed to anyone under 18.
You agree not to:
- submit forms on behalf of someone else without their permission, or submit false, misleading or automated entries;
- use the Site for any unlawful purpose, or to solicit us for unrelated goods or services;
- scrape, crawl, harvest, mirror or bulk-collect content, data or contact information from the Site, or use it to train a machine learning or generative model, without our prior written consent;
- attempt to gain unauthorized access to the Site, its forms, its hosting environment or any connected system;
- introduce malware, attempt to interfere with the Site's operation, or place unreasonable load on it;
- reproduce, republish or resell any part of the Site.
We may limit, suspend or block access to the Site at any time, without notice, if we reasonably believe this section has been breached.
Property information you submit
When you submit a form, you give us the information needed to evaluate the property — typically the address, your contact details, and a description of the property and your situation.
By submitting it, you grant us a non-exclusive, royalty-free licence to use that information for the purpose of evaluating the property, preparing and presenting an offer, and communicating with you about it. That includes sharing it, as reasonably necessary, with our staff, contractors, inspectors, title and escrow companies, attorneys, lenders and capital partners.
You confirm that you either own the property, are authorized to act for the owner, or have a legitimate interest in its sale — for example as an heir, executor, personal representative, trustee, conservator or attorney-in-fact. Submitting an address does not, by itself, establish that authority; we may ask for documentation before proceeding.
Do not send us sensitive information we have not asked for. In particular, never send bank account details, Social Security numbers, wire instructions or payment credentials through a web form or unencrypted email. Those are handled only through the escrow and title company, using their verified channels.
Wire fraud warning. Wire fraud targeting real estate closings is common. We will never send you wire instructions by email or text, and we will never ask you to change instructions at the last minute. If you receive any message that appears to come from us or from an escrow or title company changing payment details, treat it as fraudulent and call the escrow officer at a number you independently verified.
Calls, texts and email
When you give us your phone number or email address, you agree that we and the people working on our behalf may contact you about your property and your request — including by phone call, voicemail, SMS or MMS text message, and email — at the number and address you provided. This may include calls or texts sent using automated technology.
Consent to these messages is not a condition of any purchase or of receiving an offer. You may ask us for an offer and decline to be contacted by text or automated call.
Message frequency varies. Message and data rates may apply, depending on your carrier plan. Carriers are not liable for delayed or undelivered messages.
How to stop messages
- Text messages: reply STOP to any message to opt out, or HELP for assistance.
- Email: use the unsubscribe link in any marketing email.
- Calls: tell us on any call, or email us at the address in section 19, and we will add you to our internal do-not-call list.
After you opt out, we may still send you transactional messages about a transaction already in progress — for example, scheduling a walkthrough or coordinating a closing.
You agree to notify us if you give up or change a phone number you gave us, so that we do not contact someone who did not consent.
Accuracy of information
We work to keep the Site accurate and current, but we do not warrant that it is. Content may become out of date, contain errors, or be incomplete. Market figures, cost ranges and timelines change. We may correct, change or remove content at any time without notice.
Where the Site describes legal or procedural matters — probate, foreclosure timelines, tenancy rules, disclosure obligations — it is a general summary of our understanding at the time of writing, not a statement of the law as applied to your situation. Laws change, and local rules differ.
You are responsible for the accuracy of what you tell us. Offers are prepared in reliance on your description of the property, and material inaccuracies may cause an offer to be revised or withdrawn.
Our content and marks
The Site and everything in it — text, layout, design, graphics, photography, icons, code and the arrangement of it all — is owned by us or our licensors and is protected by United States copyright and other intellectual property laws.
You may view, print and download pages for your own personal, non-commercial use in evaluating a possible sale of your property. Any other use — copying, republishing, adapting, distributing, or using our content on another site — requires our written permission.
"SellMyHouseOC" and our logo and wordmark are our marks. You may not use them without our written permission, including in domain names, advertising, metadata or in any way that suggests we endorse or are affiliated with you.
Third-party services and links
The Site uses third-party services to operate, including form and communication tools, hosting, analytics and mapping. Those providers process information in accordance with their own terms and privacy policies.
The Site may link to third-party websites. We do not control them, do not endorse them, and are not responsible for their content, security or practices. Following an external link is at your own risk, and their terms will apply once you leave our Site.
Privacy
Our Privacy Policy explains what we collect, why, who we share it with, and the rights you have — including rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act. It forms part of these Terms and you should read it alongside them.
In short: we collect what we need to evaluate your property and communicate with you, we do not sell your personal information, and you can ask us to access, correct or delete it. To make a request, email us at the address in section 19.
Fair housing
We buy property in compliance with the federal Fair Housing Act and the California Fair Employment and Housing Act. We do not make buying decisions, set prices or vary our terms on the basis of race, color, religion, national origin, ancestry, sex, gender, gender identity or expression, sexual orientation, marital status, familial status, source of income, disability, military or veteran status, age, genetic information, or any other characteristic protected by federal, state or local law.
Disclaimer of warranties
THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE IS FREE OF HARMFUL COMPONENTS, OR THAT ANY FORM SUBMISSION OR MESSAGE WILL BE RECEIVED, DELIVERED OR ACTED ON.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER SELLMYHOUSEOC NOR ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). THIS LIMIT DOES NOT APPLY TO OUR OBLIGATIONS UNDER A SIGNED PURCHASE AND SALE AGREEMENT, WHICH ARE GOVERNED BY THAT AGREEMENT, AND DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR FRAUD.
You agree to indemnify and hold us harmless from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Site, or your submission of information you had no right to submit.
Some jurisdictions do not allow the limitation of liability for certain damages, so parts of this section may not apply to you.
Disputes, arbitration and class action waiver
Please read this section carefully. It affects how disputes with us are resolved, and it limits your right to go to court or to participate in a class action.
Talk to us first
Before starting a formal proceeding, you agree to email us a written description of the dispute and what you are seeking, and to give us 30 days to try to resolve it. Most problems are solved at this stage.
Arbitration
If we cannot resolve it, any dispute arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in Orange County, California, or by remote hearing if you prefer. The arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.
This does not prevent either of us from bringing an individual claim in small claims court, or from seeking injunctive relief in court to protect intellectual property rights.
No class actions
Disputes will be brought on an individual basis only. Neither of us may bring a claim as a plaintiff or class member in a class, collective, consolidated or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this paragraph is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section still applies to all other claims.
Your right to opt out
You may opt out of arbitration. Email us within 30 days of first accepting these Terms, stating your name and that you are opting out of the arbitration provision. Opting out does not affect anything else in these Terms, and it will not affect how we deal with you.
Nothing in this section waives any right you have under California law that cannot be waived, including any right to seek public injunctive relief.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. To the extent a dispute proceeds in court rather than arbitration, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California.
California notices
Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
The Site is provided to consumers at no charge. California residents may exercise their privacy rights as described in our Privacy Policy.
Changes and general terms
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "last updated" date at the top of this page and post the revised version here. Your continued use of the Site after the revised Terms are posted means you accept them. If you do not accept a change, stop using the Site. Changes do not apply retroactively to a dispute that arose before they were posted.
Severability
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in full force.
No waiver
If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.
Assignment
You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
Entire agreement
These Terms and our Privacy Policy are the entire agreement between you and us about the Site, and replace any earlier understandings on that subject. They do not replace or modify any signed purchase and sale agreement between us.
